Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between EduWin ("Company," "we," "us," or "our") and the user ("User," "you," or "your"), including parents/guardians, schools, and students, governing your access to and use of our educational services, tutoring, career advising, and subject competitions (collectively, the "Services").

1. Acceptance of Terms and Parties

1.1. Parties

These Terms apply to the individual or entity registering for the account, which may be a Parent/Guardian, a Student, or a School (acting on behalf of students). The registering party ("you" or "Account Holder") is responsible for ensuring the student(s) using the Services comply with these Terms.

1.2. Eligibility and Age Restrictions

Students must be aged 13 or over to use the Services. The Account Holder (the party registering and responsible for payment) must have the legal capacity to enter into this agreement (i.e., must be a legal adult or an authorised representative of a school/institution).

Students under the age of 18 must use the Services under the supervision of the Account Holder (parent/guardian or subscribing School).

Any student under the age of 13 who attempts to register or use the Services must have their account directly created and linked to an Account Holder (Parent/Guardian or School) who assumes full legal responsibility for their usage.

1.3. Changes

We may modify these Terms at any time. We will notify the Account Holder of material changes via email or platform notice. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

2. The Services

2.1. Description

EduWin provides a platform offering access to pre-recorded educational content, live online tutoring, career guidance, and subject-based competitions.

2.2. Accuracy of Content

While we strive to provide accurate and high-quality educational material, we do not guarantee the completeness, accuracy, or suitability of the content for any specific purpose or exam.

2.3. Competition Participation

Participation in subject competitions is governed both by these general Terms and by specific Competition Rules published separately for each event. By participating, you agree to abide by both sets of rules.

3. User Accounts and Responsibilities

3.1. Account Creation

The Account Holder must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account credentials.

3.2. Supervision (Schools and Parents)

Account Holders acknowledge and agree that students' online activity, especially during live tutoring or interactive sessions, must be supervised to ensure compliance. Schools subscribing on behalf of students assume responsibility for such supervision within the educational setting.

3.3. Prohibited Activities

You agree not to:

  • Share your account access with any unauthorised third party.
  • Use the Services for any illegal or unauthorised purpose.
  • Engage in cheating, fraud, or misconduct in competitions or educational assessments.
  • Upload, post, or transmit any offensive, harassing, illegal, or abusive material.

3.4. Reporting Misconduct

You must immediately notify EduWin if you suspect any unauthorised use of your account or if you witness any behaviour that violates the Safeguarding Policy or Acceptable Use Policy.

4. Fees, Payments, and Subscriptions

4.1. Pricing

The fees for Services, including subscriptions, tutoring packages, and school licences, are determined by a separate pricing structure which will be shared with the Account Holder upon registration or upon request. All pricing is subject to change upon prior notice.

4.2. Payment

Fees are payable in advance by the Account Holder. We use third-party payment processors. You agree to their terms and conditions related to billing and transactions.

4.3. Cancellations and Refunds

  • Subscriptions: Subscriptions renew automatically unless cancelled before the renewal date. No refunds are provided for partial subscription periods.
  • Tutoring/Advising: Specific cancellation and rescheduling policies apply to live sessions and will be detailed upon booking.
  • Competitions: Entry fees for competitions are generally non-refundable unless the event is cancelled by EduWin.

5. Intellectual Property (IP)

5.1. Our IP

All content, technology, software, designs, and materials on the EduWin platform (excluding User Content) are owned by EduWin and protected by copyright and other IP laws. You are granted a limited, non-exclusive, non-transferable licence to use this IP solely for your personal, non-commercial educational use.

5.2. User Content

You retain ownership of any content you upload, submit, or create on the platform ("User Content," e.g., essay submissions, competition entries). However, you grant EduWin a worldwide, royalty-free licence to use, reproduce, modify, and display your User Content solely for the purpose of providing the Services (e.g., sharing a competition entry with a judge, sharing student work with a tutor).

6. Limitation of Liability and Disclaimers

6.1. Disclaimer

The Services are provided "as is" and "as available." We expressly disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

6.2. Limitation of Liability

To the maximum extent permitted by law, EduWin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the Services. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

7. Governing Law and Dispute Resolution

7.1. Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

7.2. Jurisdiction

You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms.

8. Data and Privacy

8.1. Privacy Policy

Your use of the Services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information, including specific compliance with UK GDPR and the ICO Children's Code.
